Loophole respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (“DMCA”) and other applicable laws, Loophole has adopted a policy of responding to properly submitted notices of alleged copyright infringement that comply with the DMCA.

If you believe that content hosted on the Loophole platform infringes your copyright, you may submit a takedown notice as described below.

2. What to Include in Your Takedown Notice

To be legally valid under 17 U.S.C. § 512(c)(3), your DMCA notice must include the following:

  • Your full name and contact information, including email address and/or phone number;
  • A description of the copyrighted work that you believe has been infringed;
  • The exact URL(s) or specific location(s) of the infringing material on our platform;
  • A statement that you have a good faith belief that the use of the content is not authorized by the copyright owner, its agent, or the law;
  • A statement, under penalty of perjury, that the information you’ve provided is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner;
  • Your electronic or physical signature.

Incomplete or vague notices may be ignored.


3. What Happens After You Submit a DMCA Notice

Once we receive a valid DMCA notice:

  • We will promptly remove or disable access to the allegedly infringing content;
  • We may notify the user who uploaded the content and provide them with a copy of your notice;
  • The user may have the right to submit a counter-notification under the DMCA, at which point we may restore the content unless you file a court action.

4. Counter-Notification Procedure (If You’re the Uploader)

If you believe your content was removed by mistake or misidentification, you may submit a counter-notification to our DMCA Agent.

Your counter-notice must include:

  • Your name, address, phone number, and email address;
  • A description of the material that was removed and where it was located before removal;
  • A statement, under penalty of perjury, that you have a good faith belief that the content was removed as a result of mistake or misidentification;
  • A statement that you consent to the jurisdiction of the federal district court for your judicial district (or, if outside the U.S., to the jurisdiction of the courts in Los Angeles, California), and that you will accept service of process from the original complainant;
  • Your electronic or physical signature.

If we receive a valid counter-notification, we may restore the content within 10 to 14 business days, unless the original complainant files a lawsuit.


5. Repeat Infringers

Loophole reserves the right to terminate accounts of users who are determined to be repeat infringers of copyright or who abuse the DMCA process.


6. Abuse of DMCA Policy

Filing a false or bad-faith DMCA notice or counter-notice is a violation of U.S. law and may result in legal liability for damages, court costs, and attorney’s fees. If you’re unsure whether content on Loophole infringes your copyright, we recommend consulting a qualified attorney before filing.


7. Platform Context

Loophole is a technology platform that empowers users to upload files, initiate communications, and generate content using our tools. While we do not proactively monitor all content, we take copyright concerns seriously and aim to act swiftly upon valid notice.
